Samuel E. Story appeals from the denial of his motion to vacate his sentence, pursuant to either Federal Rule of Criminal Procedure 32 or 28 U.S.C. §§ 144 and 455. Story pled guilty to one count of conspiracy to transport stolen goods in interstate commerce in violation of 18 U.S.C. § 371. The district court sentenced him to the maximum five years imprisonment and imposed the maximum $10,000 fine. Story moved to have his sentence vacated on the grounds that it was illegally imposed and to have the district judge disqualified for prejudice. The district court denied his motions and we affirm.
