Appeal from a final judgment entered May 7, 1998 (Frederic Block, Judge), dismissing plaintiffs employment discrimination action in toto. We conclude that the District Court correctly dismissed plaintiffs claim against his union on the ground that the union was not named in plaintiffs right to sue letter from the EEOC. However, because there was no indication in the record that plaintiff understood summary judgment procedures and because the District Court inappropriately resolved an issue of material fact, we hold that the District Court erred in dismissing plaintiffs claim against his employer on summary judgment.
